Join the Montana Chamber of Commerce for a webinar to Protect your Business when using Background, Credit Reports and Criminal History Information in Employment Decisions and General Business Operations

The Equal Employment Opportunity Commission (EEOC) released updated guidelines for employers that use information on criminal convictions or arrests in their hiring process. The use of background and credit reports in the hiring process requires employers to adhere to numerous requirements contained in the Fair Credit Reporting Act (FCRA) and Fair and Accurate Credit Transactions Act (FACTA) from disclosures to applicants to storage, destruction and security of the information. Failure to stay informed and in compliance can be a costly mistake.

The webinar, conducted by Steve Cape of GeniusHR in Great Falls, will analyze and explain the EEOC guidance on the use of criminal records in the hiring process and the employer's responsibility to properly disclose that a background or credit report is going to be used in the hiring process. The goal of the webinar is to give attendees practical insights into how to protect their company.

    The webinar will:

    • Discuss the requirements for justifying an adverse hiring decision based on criminal history
    • Review the basics of the use of criminal history in the hiring process
    • Reveal best practices for requiring background checks and credit reports
    • Discuss when to ask applicants about criminal history
    • Outline what information if any can be considered
    • Examine what steps are strongly suggested by the EEOC to keep in compliance
    • Cover what disclosures are required before asking for authorization to request a report
    • Cover notices and steps must be taken prior to taking an adverse action based on information in a report
